Terms of Use

The agreement between you and Visor Inc. for using Visor.

These terms are the agreement between you and Visor Inc., a Texas corporation ("I", "me"), for the Visor app and its servers. I'm Areg, I run the company, and I've written this in the first person because there is one person here. Installing or using Visor means you accept them. If you don't, don't use it.

Visor is young and changes often. Features appear, change, and get removed. It can be unavailable, lose data, or behave in ways I did not intend. That includes a bug showing your data, such as where you are or where you have ridden, to someone who was not meant to see it. Keep your own copy of anything you can't afford to lose — you can export your rides as GPX. If the chance of a bug exposing your rides is more than you want to take, use Visor without an account: your rides stay on your phone and are not sent to my server.

3. Your account

You can use Visor without an account. If you make one, keep control of the passkey behind it, and tell me at tell@visor.cc if you think someone else has it. You must be at least 13 years old (16 in the EEA and UK) to have an account, and old enough to legally ride wherever you ride.

4. Sharing your position

Visor shows your live position to riders you have added. Only add people you actually want tracking you, and only share when you mean to. Do not use Visor to follow, monitor, or locate anyone who has not knowingly agreed to it — that includes putting a phone on someone else's bike or in their gear. Accounts used that way get terminated.

The app itself — its code, design, name, and artwork — stays mine. You get a personal, non-exclusive, non-transferable licence to use Visor on devices you own or control, for as long as these terms hold.

7. Other people's services

Visor draws maps and routes from third parties, including OpenFreeMap, Mapbox and OpenStreetMap contributors. Their data and their terms are their own, and I can't guarantee either.

8. Cost

Visor is free right now. If that ever changes, I'll say so clearly in the app before charging anyone, and you'll be able to walk away.

9. Ending it

You can stop at any time: delete your account in the app, or by emailing me, and uninstall. I can suspend or end an account that breaks these terms, or shut the service down entirely — if I ever do the latter, I'll give as much notice as I reasonably can so you can export your rides.

10. No warranty

Visor is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, security, freedom from bugs, and non-infringement. Some places don't allow that exclusion; where they don't, it doesn't apply to you.

11. Limits of liability

To the fullest extent the law allows, I am not liable for indirect, incidental, special, or consequential damages, or for lost data, lost rides, or losses arising from riding. The same goes for losses from your data being seen by someone who was not meant to see it, whether that came from a bug, a mistake or negligence on my part, or someone breaking in. My total liability to you for any claim is capped at the greater of the amount you paid me for Visor in the previous twelve months, or twenty US dollars. Nothing here limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud.

12. Indemnity

If your use of Visor breaks these terms or the law and that costs me a claim, you'll cover the reasonable cost of it.

13. Changes

If these terms change, the date at the top changes with them, and for anything material I'll say so in the app before it takes effect. Continuing to use Visor after that means you accept the new version.

14. Law and venue

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, and any dispute belongs in the state or federal courts of Travis County, Texas. If you are a consumer somewhere with stronger local protections, those still apply to you.

15. If you got Visor from the App Store

These terms are between you and me — Apple is not a party to them. Apple has no obligation to provide support for Visor. If Visor fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price, if any; beyond that, Apple has no warranty obligation. Any claim about Visor — product liability, a failure to meet a legal requirement, a consumer protection claim, or an intellectual property claim — is mine to handle, not Apple's. You confirm you are not in a country subject to a US embargo or designated as terrorist-supporting, and that you are not on any US list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Odds and ends

If a clause here turns out to be unenforceable, the rest stands. Not enforcing something once doesn't waive it. These terms plus the Privacy Policy are the whole agreement between us about Visor.
